Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Pokécha (“Pokécha,” “we,” “us”). By creating an account or using the site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Pokécha.

1. What Pokécha is

Pokécha lets users pay to open digital gacha packs that are backed by physical graded trading cards (“slabs”) held in our vault. Every pack publishes the exact chance of every outcome before you buy, and every opening returns something of value — a win means a physical slab is held in the vault under your name; a miss returns consolation value (store credit or a lower-tier pack). No opening ever resolves to nothing.

2. Eligibility

You must be at least 18 years old to open a pack or hold a balance on Pokécha. We require a date-of-birth attestation before your account can purchase anything; browsing packs and reading published odds does not require an account or age attestation. Accounts are personal — one account per person — and you are responsible for keeping your sign-in secure.

Pokécha is not available in every jurisdiction. Access to purchasing/opening may be blocked based on your location; browsing and odds disclosure remain available regardless of jurisdiction.

3. Accounts

You sign in with Google OAuth. You are responsible for all activity under your account. Tell us immediately if you believe your account has been compromised. We may suspend or terminate an account for violating these Terms, for fraud or abuse, or as required by law.

4. Purchases & pricing

Pack prices and odds are set in our configuration and are never written by hand into marketing copy — the price and odds you see are the exact numbers the draw runs against. All charges are processed through our payment provider once live payments are enabled; charges are generally final except as described under Sell-back (§6) or as required by law. A valid, unredeemed referral code may discount your first purchase only (§7) — a discount changes what you pay, never what a pack pays out.

5. Odds & fairness proof

Every pack page shows the published odds table pulled from the same solved configuration our random-draw engine draws against — there is no separate marketing number that can drift from what actually happens. Before each draw, the server commits to a secret seed by publishing its hash; after the draw, the seed is revealed so you (or anyone) can recompute the roll and confirm it matches the committed hash and the tier you were awarded. This is what we mean by proof-backed: you don't have to trust us, you can check. Card values shown with a “~” are estimates of live market value and move with the market; store credit and bonus-pack values are exact.

6. Physical slabs, vault custody, shipping & sell-back

A won slab is held in our vault under your name — it is your property, custodied by us, from the moment it's awarded. You may request it be shipped to you, or sell it back to us at the pack's published buyback rate. Sell-back payouts above a threshold we set require manual review before payout. Shipping and sell-back are subject to additional terms and processing times posted at the time those features are enabled.

7. Referral program

Some users are granted an exclusive referral code by us. A code can only be created by us for a specific person — there is no self-service way to generate one. A code discounts the redeemer's first purchase only; a person can redeem at most one referral code ever, and a code's owner cannot redeem their own code. We record every code and every redemption and may revoke a code at any time.

8. Prohibited conduct

You agree not to:

• Create or use more than one account to evade limits (age, referral, consolation, or otherwise);
• Use bots, scripts, or automation to interact with the site or its APIs;
• Attempt to reverse, tamper with, or spoof the fairness-proof mechanism;
• Initiate a chargeback or payment reversal in bad faith for a completed opening;
• Use the service if you are under 18 or located somewhere Pokécha is blocked;
• Resell, sublicense, or misrepresent the origin of a slab obtained through Pokécha in a way that misleads a third party.

Violating any of these may result in suspension, forfeiture of an involved balance, and account termination.

9. Intellectual property

Pokécha is an independent platform. We are not affiliated with, sponsored by, or endorsed by Nintendo, Game Freak, Creatures Inc., Pocketpair, Shueisha, Toei Animation, Eiichiro Oda, or any other publisher, developer, or rights holder of the franchises depicted on cards available through the platform. All trademarks, character names, and artwork remain the property of their respective owners. Pokécha packages and distributes physical, third-party-manufactured and third-party-graded collectible trading cards; we do not manufacture, print, or claim any ownership interest in the underlying intellectual property. The Pokécha name, logo, and site design are our own property.

10. Risk disclosure

Opening a pack is a chance-based mechanic: the value you receive on any single opening may be worth less than what you paid, even though every opening returns something of value and the published odds and expected value are always honored exactly. A card's live market value can fall as well as rise. Nothing on Pokécha is investment advice, and packs should not be purchased as an investment strategy.

11. Disclaimers & limitation of liability

Pokécha is provided “as is” without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, Pokécha and its founders are not liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

12. Termination

You may stop using Pokécha at any time. We may suspend or terminate access for a violation of these Terms, suspected fraud, or a legal requirement. Sections that by their nature should survive termination (intellectual property, risk disclosure, limitation of liability, governing law) do survive.

13. Governing law & disputes

These Terms will state a specific governing law and dispute-resolution process before Pokécha accepts real payments.

14. Changes to these Terms

We may update these Terms as the product changes. Material changes will be reflected by updating the date above, and, once accounts hold real balances, by direct notice before the change takes effect.
